What is GST?

The GST means “Goods and Service Tax”. In layman’s terms, GST is the tax that is levied on the consumers on goods as well as services purchased by them.

 

The Goods and Services Tax Act came into effect on 1st July 2017, Government in the year GST is an indirect tax that is paid to the Central Government for the goods and services.

 

There are a few basic key points in GST

 

  • In each stage of production starting from manufacture to the final production value is added to the product.

 

The steps are as stated below.

  1. Raw materials
  2. Cookies (value-added)
  3. Packaging of Cookies
  4. (Value Added)
  5. Final Product + GST

 

At every stage, the value is added to the goods and finally, the total monetary value that has been added at each stage due to value addition has been borne by the final consumer.

  • GST is a single tax that has been levied on the ultimate consumer and the seller passed the same to the Government.

 

  • There are many indirect taxes in the economy such as Excise duty, VAT, Service tax, etc. and GST has been introduced to replace them.

 

  • The basic aim of GST is to eliminate the complex and various taxes, with different headings and to bring all under the single tax like GST, eliminate double taxation, which in the turn will reduce the price of the product.

 

  • GST is destination-based. If the seller of the product is in Karnataka and the final buyer of the product is in Kerala then the GST will be levied on the buyer in Kerala. The entire tax revenue shall go to Kerala and not to Karnataka.

 

The GST is of 3 types of GST in India

  • CGST (Central Goods and Service Tax)
  • CGST is levied by the Central Government and it will be followed by CGST Act.
  • SGST (State Goods and Service Tax): This tax is collected by the State Government on Intrastate sale.
  • IGST (Integrated Goods and Service Tax): In this case, the sale transaction is conducted between two states, and the tax is collected by the central government.

 

How the above three types of GST work

 

Suppose the seller in Karnataka sold his goods to the buyer in Tamil Nadu. In this case, IGST shall be levied and the amount shall be collected by the central government. The Centre will then share the collected GST with the states according to the final destination of the goods. The ratio of the distribution of GST between the Centre and State shall be 50: 50.

 

The pre-GST era and the cascading effect of various taxes:

  • In the pre-GST era, there were various indirect taxes levied by the central government as well as state governments and tax rates are different in different states in many cases.
  • Through VAT states collected tax, however, rates of VAT are different in different cities.
  • Excise duty was charged by the Central government on the production/manufacture of goods and VAT was also charged by the State Government. This is called the cascading effect of taxes or tax on tax effect.

 

5 Advantages of GST

 

1. GST helped in the reduction of prices in goods:

Earlier at every stage of production tax was levied and hence the prices of the goods were higher. After the introduction of GST at each stage of production, the tax liability was passed on. The final tax was paid at once by the final customer.

 

In this way, double taxation on the same product was stopped, and ultimately the cost of production declines thereby reducing the price of the product.

 

2. GST increased the bracket for tax payment:

Earlier before GST, a small business with a turnover of over 5 lakhs was liable to pay tax (VAT)and taxation is different in different states. For service providers, the limit was 10 lakhs.

 

However, after the introduction of GST, the limit has increased to 20Lakhs, which in turn benefits many small traders. For the North-East states, the limit is 10 lakhs.

 

3. Composite Scheme:

The small business that has turnover below 1.5 cr. can avail of this scheme. For North-Eastern states, the same is 75 lakhs. Under this scheme, the taxpayers can pay the GST at a fixed rate of turnover. This scheme leads to a reduction of the tax burden on small businesses.

 

4. Unified filing:

One of the greatest advantages of GST is the Unified filing of taxes. Earlier under the pre-GST regime, a business owner has to file various taxes under various headings and it was a very tedious process. GST has made the whole tax filing process simple and less complicated as there is just one unified tax that needs to be filed.

 

5. E-commerce business:

Before the implementation of GST, there was a lot of confusion in the E-commerce sector as the VAT was different in different states and the supply of goods was not clearly defined in respect of the e-commerce sector. Under GST, the provisions were defined very clearly for e-commerce, in turn, simplified the logistics and helped to run the business smoothly.

 

6. Impact on the unorganized sector:

GST has brought the regulations and accountability of the unorganized sector. Even though initially there are few hiccups and an increase in the operational cost for various businesses under GST, one has to remember that to run a business effectively and smoothly in the long run, the business has to be organized and regulated.

 

GST in India is still at a very infant and unstable phase, over some time slowly but surely it will stabilize and streamline. During this transition period of the GST, the importance of the GST certification course for CA students is very significant.
